4. Booking and Reservations

4.1 Booking Process

To book our photography services:

• Submit an inquiry through our contact form, email, or phone
• Attend a consultation (in-person or virtual) to discuss your requirements
• Review and sign the photography service agreement
• Pay the required deposit to secure your booking

4.2 Deposit Requirements

• A non-refundable deposit of 30-50% of the total service fee is required to confirm your booking
• The deposit amount varies by service type and will be specified in your service agreement
• Your booking is not confirmed until we receive the deposit payment
• Deposits are applied toward your final balance

4.3 Payment Terms

• Full payment is due prior to or on the day of the photography session unless otherwise agreed in writing
• We accept payment via bank transfer, credit/debit cards, and other methods as specified
• Late payments may result in delayed delivery of final photographs
• Outstanding balances may incur late fees as specified in your service agreement

5. Cancellations and Rescheduling

5.1 Client Cancellations

• Cancellations made more than 60 days before the scheduled session: Deposit refunded minus 20% administrative fee
• Cancellations made 30-60 days before: 50% of total fee forfeited
• Cancellations made less than 30 days before: Full payment required, no refund
• Wedding cancellations are subject to specific terms outlined in the wedding photography agreement

5.2 Rescheduling

• One free rescheduling allowed if requested at least 14 days in advance
• Additional rescheduling requests may incur fees
• Subject to photographer availability
• Weather-related rescheduling for outdoor sessions handled on a case-by-case basis

5.3 Photographer Cancellations

• In the unlikely event we must cancel due to illness, emergency, or unforeseen circumstances, we will provide a full refund or reschedule at no additional cost
• We will make reasonable efforts to provide a qualified substitute photographer of equal caliber
• Our liability is limited to the amount paid for services

6. Photography Session Conduct

6.1 Client Responsibilities

• Arrive on time for scheduled sessions; late arrivals may result in shortened session time
• Provide accurate location information and any necessary access permissions
• Ensure all participants have consented to being photographed
• Disclose any special requirements or restrictions in advance
• Cooperate professionally with the photographer and any assistants

6.2 Session Coverage

• Coverage hours and scope are as specified in your service agreement
• Additional hours beyond contracted time may be available at the hourly rate specified
• Meal breaks for sessions exceeding 6 hours will be provided as agreed
• Travel expenses for locations beyond 25 miles from our studio may apply

6.3 Weather and Environmental Conditions

• Outdoor sessions are weather-dependent
• We will work with you to reschedule if weather conditions are unsuitable
• Final decision regarding weather suitability rests with the photographer
• Backup indoor locations should be discussed in advance when possible

7. Copyright and Intellectual Property

7.1 Photographer Rights

• Breeze Market Tangle retains full copyright ownership of all photographs taken
• We reserve the right to use photographs for portfolio, marketing, website, social media, competitions, and promotional purposes
• Photographs may be submitted to professional photography publications and organizations
• Copyright includes but is not limited to reproduction, display, and distribution rights

7.2 Client Usage Rights

• Clients receive a personal usage license for purchased photographs
• Personal use includes sharing with family and friends, social media posting with credit, and personal printing
• Commercial use requires separate licensing and additional fees
• Clients may not sell, reproduce for profit, or claim copyright ownership
• Editing or altering photographs without permission is prohibited

7.3 Image Credits

• When sharing photographs online or in print, credit should be given to "Breeze Market Tangle" where possible
• We appreciate tags and mentions on social media platforms

8. Image Delivery and Editing

8.1 Delivery Timeline

• Portrait sessions: 2-3 weeks from session date
• Wedding photography: 6-8 weeks from wedding date
• Event coverage: 3-4 weeks from event date
• Timelines are estimates and may vary during peak seasons

8.2 Editing and Post-Processing

• All delivered photographs undergo professional editing and color correction
• Editing style is consistent with our portfolio and agreed aesthetic
• Minor retouching is included; extensive retouching may incur additional fees
• We deliver curated selections of the best images, not all photographs taken

8.3 Delivery Method

• Digital images delivered via secure online gallery
• High-resolution files included for personal use and printing
• Gallery access typically available for 90 days; downloads should be completed during this period
• USB drives or physical prints available for additional fees

9. Liability and Limitations

9.1 Equipment Failure

• While we use professional backup equipment, we are not liable for equipment failure beyond providing refund or rescheduling
• We maintain comprehensive insurance for equipment and professional liability

9.2 Lost or Corrupted Images

• We implement multiple backup systems to protect your photographs
• In the unlikely event of data loss, our liability is limited to refunding fees paid
• We cannot be held liable for emotional distress or consequential damages resulting from image loss

9.3 Third-Party Venues and Vendors

• We are not responsible for restrictions imposed by venues or other vendors
• Clients are responsible for informing us of any photography restrictions in advance
• Failure to obtain necessary permissions may affect coverage and deliverables

9.4 Force Majeure

• We are not liable for failure to perform services due to circumstances beyond our control including natural disasters, pandemics, government restrictions, or other force majeure events
• In such cases, we will work with clients to reschedule or provide refunds as appropriate

10. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy and applicable data protection laws including GDPR. Please review our Privacy Policy for detailed information about data collection, usage, and protection.

11. Model Release

By booking our services, you grant Breeze Market Tangle permission to use photographs containing your likeness for promotional purposes unless you explicitly opt out in writing. Opting out does not affect your service but may limit certain portfolio usage.

12. Disputes and Complaints

• If you are dissatisfied with our services, please contact us within 14 days
• We will respond to complaints within 5 business days
• We strive to resolve all issues amicably and professionally

13. Warranty Disclaimer

Our photography services are provided on an "as is" basis. While we strive for excellence, we make no warranties regarding specific outcomes, number of images delivered, or particular shots captured. Creative photography involves artistic interpretation and technical variables beyond complete control.

14. Indemnification

You agree to indemnify and hold harmless Breeze Market Tangle, its owners, employees, and associates from any claims, damages, or expenses arising from your violation of these Terms or misuse of our services or photographs.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Continued use of our services following changes constitutes acceptance of modified Terms.

17. Entire Agreement
